RESOLUTION NO. 36-98

A RESOLUTION ENACTING MUNICIPAL ORDINANCE NO. 01-98

WHEREAS, the Taal Lake is one of the major sources of fresh water in the country and is home to rare and endemic species, namely Maliputo and Tawilis;

WHEREAS, the proliferation of jetski operation in Taal Lake is posing an environmental threat to these species by oil spillage and disturbance of breeding grounds of same species in Taal Lake among others;

WHEREAS, said activities also pose danger to the safety of fishermen, commuters and swimmers in Taal Lake;

WHEREAS, the Presidential Commission on Tagaytay-Taal (PCTT) Integrated Master Plan recommend the protection and regulations of the fish industry in Taal Lake;

NOW THEREFORE, for the environmental protection of Taal Lake on the jurisdiction of the territorial waters of Talisay, Batangas of the endemic species and for the safety of swimmers and tourists the Sangguniang Bayan of Talisay, Batangas in session assembled, ordained that:

AN ORDINANCE DECLARING A TOTAL BAN AND PROHIBITING THE USE AND OPERATION OF JETSKIS AND SIMILAR WATERCRAFTS WITHIN THE TERRITORIAL WATERS OF THE MUNICIPALITY

Section 1. The use and operation of jetskis within the territorial waters of the municipality is hereby declared illegal and prohibited;

Section 2. All resorts and other tourism-oriented establishment within the area are required to clearly inform their guest verbally and post copies of this ordinance in their establishments;

Section 3. All PNP personnel and Barangay Official are authorized to give due notice, cause and effect the arrest of the violators of this ordinance;

Section 4. Violators of the said ordinance shall be meted a fine of maximum of P2,500.00 and the said jetskis shall be confiscated for disposition in accordance with law;

Section 5. Resort and tourism establishment owners and/or operators where the said jetskis are launched or who knowingly allow the use and operation thereof shall be subject to the following penalties:

 First Offense   P 1,500.00
 Second Offense   2,500.00
 Third Offense   Cancellation of Mayor’s Permit

Section 6. This Ordinance shall take effect upon its approval.
